1. Acceptance of Terms

By accessing or using PropTabs at proptabs.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

PropTabs provides online real estate calculators and analysis tools, including mortgage calculators, affordability estimators, rental property analyzers, and related financial tools (collectively, the "Tools"). The Service is provided for general informational and educational purposes only.

3. Not Financial, Legal, or Professional Advice

THE TOOLS AND ALL OUTPUT GENERATED BY THE SERVICE ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE FINANCIAL, INVESTMENT, TAX, LEGAL, ACCOUNTING, OR ANY OTHER PROFESSIONAL ADVICE.

All calculations, estimates, projections, and figures produced by PropTabs are illustrative only. They are based on the inputs you provide and simplified mathematical models that may not reflect actual market conditions, lender requirements, tax implications, or any other real-world factors specific to your situation.

You should not rely on the Service as a substitute for advice from a licensed financial advisor, mortgage broker, real estate professional, attorney, or accountant. Before making any real estate, mortgage, or investment decision, consult qualified professionals who can evaluate your specific circumstances.

4. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROPTABS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY OUTPUT OR CONTENT
WARRANTIES THAT ANY DEFECTS WILL BE CORRECTED

Default values, estimates, and assumptions used by the Tools (such as property tax rates, insurance rates, and maintenance costs) are based on general national averages and may not reflect conditions in your area. Actual costs will vary.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROPTABS, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF PROFITS, REVENUE, SAVINGS, OR BUSINESS OPPORTUNITIES
FINANCIAL LOSSES ARISING FROM RELIANCE ON THE TOOLS OR THEIR OUTPUT
LOSS OF DATA OR SAVED ANALYSES
COSTS OF SUBSTITUTE SERVICES
ANY OTHER LOSS OR DAMAGE OF ANY KIND

THIS APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH SUCH DAMAGES ARE SOUGHT, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF PROPTABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN ALL CASES, PROPTABS'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED TEN DOLLARS ($10.00).

6. Indemnification

You agree to indemnify, defend, and hold harmless PropTabs and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) any financial or other decision you make based on output from the Service; or (d) your violation of any third-party rights.

7. Accounts and Data

You may create a free account to save property analyses. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. PropTabs reserves the right to suspend or terminate accounts that violate these Terms.

We make reasonable efforts to maintain the availability of the Service, but we do not guarantee that saved analyses or account data will be preserved indefinitely. You are responsible for maintaining your own records of any analyses you wish to retain.

8. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to any part of the Service or its infrastructure
Scrape, crawl, or systematically extract data from the Service without written permission
Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service
Use the Service to provide competing services without written permission
Transmit any malicious code, viruses, or disruptive content

9. Intellectual Property

All content on PropTabs, including the tools, guides, text, graphics, logos, and software, is the property of PropTabs and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Service without our express written permission.

You retain ownership of the property data you input into the Service. By using the Service, you grant PropTabs a limited license to store and process that data solely for the purpose of providing the Service to you.

10. Third-Party Links and Services

The Service may reference or link to third-party websites or services. PropTabs is not responsible for the content, accuracy, or practices of any third-party sites. Links do not constitute an endorsement. Your use of third-party services is governed by their own terms and policies.

11. Termination

PropTabs reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 3, 4, 5, 6, and 9 of these Terms survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall be resolved through binding individual arbitration rather than in court, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
